Mission

Our team aims to tackle and discuss the multiple layers of Musical Copyright Infringement cases, particularly in the Philippines. Namely, Musical Parodies, Interpolation, Sampling, Music leaks, Cover Songs, Piracy, and Unauthorized Public Performances. Through research, advocacy, and education we aim to raise awareness of the rising issue of copyright infringement among musical works, provide support, and promote solidarity and ethical practices in combating piracy.​

Republic Act 8293: 
The Intellectual Property Code of the Philippines

Copyright is the legal protection extended to the owner of the rights in an original work. By original work, meaning every production in the literary, scientific, and artistic domains. The Intellectual Property Code of the Philippines or ID Code of the Philippines states that books, writings, films, paintings, computer programs, and most importantly musical works are are all under the copyright law. The copyright of a work remains protected during its creator's lifetime until after 50 years of their death. This rule applies to all.

Rights of a copyright owner

According to RA 8293, the Rights of a Copyright Owner includes:

  • Reproduction of the work or substantial portion of the work

  • Dramatization, translation, adaptation, abridgment, arrangement or other transformation of the work;

  • The first public distribution of the original and each copy of the work by sale or other forms of transfer of ownership;

  • Rental of the original or a copy of an audiovisual or cinematographic work, a work embodied in a sound recording, a computer program, a compilation of data and other materials or a musical work in graphic form, irrespective of the ownership of the original or the copy which is the subject of the rental

  • Public display of the original or a copy of the work;

  • Public performance of the work; and

  • Other communication to the public of the work.

What copyright means to music

  • Copyright infringement in the music industry is the use, distribution, reproduction, and performance of copyrighted music without permission from the copyright holder. This means using music in any form such as live performances, videos, streaming, sampling, or song covers without the necessary licenses violates the copyright infringement law and can result in legal action. 

  • Copyright serves as to protect artists against illegal use of their work.
